9.2 Furthermore, RedCabin assumes no contractual obligation to monitor the information transmitted or stored by users for violations of these terms and conditions or to actively investigate circumstances indicating a violation of use.
9.3 If facts become known indicating a violation of the law, RedCabin will take reasonable measures in the specific individual case.

10.2 RedCabin will process the reported information in a timely, diligent, non-arbitrary, and objective manner.
10.3 If RedCabin is in good faith convinced of a violation and/or an Inappropriate Content, the following measures, depending on the nature and severity, may be taken by RedCabin without prior hearing of the Member:
10.4 If the Member was not heard before the measure was taken, the Member is granted the right to make a counter-submission.

10.6 Before a Member is expelled, the Member is given the right to comment. RedCabin will take this statement into account in the decision-making process.
10.7 The affected Member will be informed in writing (e.g., via email) about measures taken according to Section 10.3. The notification contains information to possibilities for redress in respect of that decision. Cause for termination exists especially when:
12.1 RedCabin liability, as well as that of its legal representatives and vicarious agents within the meaning of § 278 BGB, is limited to cases of intent or gross negligence. For slight negligence, RedCabin, its legal representatives, and vicarious agents within the meaning of § 278 BGB shall only be liable if it concerns the violation of a material contractual obligation, the fulfillment of which enables the proper execution of the contract in the first place or the violation of which endangers the achievement of the purpose of the contract and on whose compliance the Member regularly relies.
12.1 RedCabin liability, as well as that of its legal representatives and vicarious agents within the meaning of § 278 BGB, for slight negligence is limited to foreseeable, direct damages. Liability for other consequential damages is ex-cluded, in particular liability for lost profits and savings not achieved.
12.3 RedCabin liability, as well as that of its legal representatives and vicarious agents within the meaning of § 278 BGB, for slight negligence is – regardless of the legal basis – limited in total to the contract value, in the case of ongoing compensation to the amount of the usage fee.
12.4 RedCabin endeavors to keep RedCabin Social available to the satisfaction of its Members. However, the Member acknowledges that due to maintenance work or other technical measures on RedCabin Social, as well as events be-yond the control of RedCabin, e.g., due to influences of the internet provider hosting RedCabin Social, continuous availability cannot be guaranteed. Therefore, liability claims based on the non-availability of RedCabin Social or its parts are excluded unless they are based on intentional or grossly negli-gent breaches of duty by RedCabin or its legal representatives or vicarious agents within the meaning of § 278 BGB.
12.5 In the event of loss of Member content contributed to RedCabin Social, espe-cially graphics, texts, images, RedCabin, its legal representatives, and vicari-ous agents within the meaning of § 278 BGB shall only be liable for the ex-penditure required for data restoration if proper data backup was performed by the Member. Liability of RedCabin, its legal representatives, and vicarious agents within the meaning of § 278 BGB for slight negligence arises only if the Member had conducted proper data backup immediately before the measure leading to data loss.
12.6 RedCabin is not liable for the functioning of internet infrastructures or trans-mission paths, or customer networks that are not within the responsibility of RedCabin or its vicarious agents.
12.7 All aforementioned disclaimers and limitations of liability do not apply to injury to body, health, or life.
12.8 To clarify, we summarize when the aforementioned disclaimers/limitations of liability do not apply.
12.9 The disclaimer/limitation of liability under this Section 12 does not apply to lia-bility for death or personal injury or for intent, gross negligence, or intentional misconduct, or in cases of negligence in breach of a material duty, where a material duty is one that is essential for the provision of our services and on which you may reasonably rely, but only to the extent that the damage was directly caused by the breach and was foreseeable at the time of contract conclusion and to the extent that they are typical within the scope of this con-tract.
12.10 Liability for stored Member information RedCabin is not liable for the information provided by you and the information stored on your behalf if we:
